The Anti-Corruption Bureau (ACB) has asked High Court Judge Kenyatta Nyirenda to recuse himself from hearing an application for judicial review by former Police Inspector General George Kainja.
In the judicial review application, the former IG wants the Bureau to stop prosecuting him because he was arrested based on imported evidence.
But according to ACB, Judge Nyirenda is conflicted to handle the judicial review application matter.
“We cannot proceed before the court until what we are raising has been decided upon by the same court until the issues we have the court has looked at them
“So, basically we filed that paper to seek for preliminary objections to proceeding before the court,” argued Chrispine.
Khunga, the Bureau’s Director of Legal and Prosecutions.
However, the Claimants did not respond to the preliminary objection arguing that the papers were not properly filed.
The judge will deliver his ruling on the objection on October 3, 2022.
On June 23, 2022, the graft-bursting body arrested Kainja for receiving advantage from Zuneth Sattar, Managing Director of Xaviar Limited on account of influencing a procurement contract reference number MPS/SB/16/04/2021 to supply 350,000 food ration packs worth $7, 875,000.00 by unlawfully initiating a requisition of the procurement on instruction of Sattar.
According to ACB, investigations conducted established that Kainja solicited an advantage in form of a vehicle and $8,000 from Sattar for influencing the award of the contract to supply the food ration packs.
The investigation also established that Mwabi Kaluba, Deputy Commissioner of Police and Service Legal Officer, corruptly obtained $20,000.00 from Sattar as an advantage for giving assistance in the procurement contract of the food ration packs.
