The Supreme Court of Appeal has ordered the release of former president Peter Mutharika’s security aide, Norman Chisale on bail without any conditions.
An order signed by Justice Lovemore Chikopa says the courts have found that Chisale was unlawfully detained following his arrest in regards to corruption and attempted murder charges.
He said with the period he has been detained, imposing bail conditions will be extreme.
Read part of the statement: “If need be of any conditions then the ones which were earlier imposed by the Lilongwe magistrate court and high court in Blantyre would be applied”.
Justice Chikopa further said that the state is well aware that Chisale was illegally detained but has been reluctant to grant him bail.
The personal security aide for former president Mutharika was first arrested on 28th July 2020 for being suspected to have tampered with public resources and since then he has been arrested three times consecutively on attempted murder, corruption and murder of former ACB’s official Issa Njauju.
