Defence lawyers in the K2 billion cashgate case involving former Malawi Defence Force (MDF) Army Commander General Henry Odillo and 3 others have asked for more time to file their submission.
Odillo, MDF Deputy Commander Clement Kafuwa, former Accountant General David Kandoje and Ganizani Kuchombo are being accused of fraudulently paying arms supplier Thuso Group about K2 billion for a contract despite not supplying the arms.
But appearing before Judge Redson Kapindu on Tuesday in Lilongwe, the Defence applied for extra days to file their submission before the Court determines on whether there is case to answer.
“We were supposed to give oral submissions on whether there is a case to answer or no case to answer but the Defense applied for extra days because they underestimated the amount of work involved, a lot of documentation, a lot of witness statements so they asked for more time.
“So, the first (Odilo) and second (Kafuwa) accused have been given seven days to file their submissions and Mr. Kandoje the third accused has been given fourteen days to file their submissions,” said Kamudoni Nyasulu, one of the state-hired lawyers.
High Court Judge Redson Kapindu is expected deliver his ruling once he gets the written submissions.
According to Nyasulu, when the court resumes at a prescribed time, there will be no submission of oral submissions.
The State paraded a total of 27 witnesses in the case.
