High Court Judge Kenyatta Nyirenda has nullified the appointment of Malawi Electoral Commission (Mec) Commissioners who were appointed by former President Peter Mutharika.
The Court has since ordered the Democratic Progressive Party (DPP) to submit three nominees to President Lazarus Chakwera in a period of seven days for his consideration.
In addition, Nyirenda has ordered the Malawi Congress Party (MCP) to resubmit the nomination of Richard Chapweteka as MEC Commissioner within seven days too.
“The effect of the judgement is to nullify the appointment who were nominated by the DPP, their appointments have been nullified meaning from today they are no longer commissioners of MEC.
“The former President Mutharika deliberately breached the law when he knew what the law is and the Judge even used Chichewa in this one is like the former President was telling the Members of Parliament (MPs) mumati mungatani?” said Likongwe.
According to Nyirenda, the ruling will not have any impact on the outcome of the recently court sanctioned fresh presidential election.
Meanwhile, lawyer representing Commissioners Arthur Nanthulu and Steve Duwa; Gabriel Chembezi said he will map the way forward once his clients see the judgement.
“As for the MEC Commissioners they were just added, because they would be affected decision of the Court so the main players were the MCP and the Office of the President.
“Since I was representing some of the MEC Commissioners we have to sit down and determine the way forward,” said Chembezi.
DPP Commissioners whose their appointments have been nullified are Jean Mathanga, Linda Kunje, Arthur Nanthulu and Steve Duwa.
