Speaker of the National Assembly Catherine Gotani Hara says Parliament will comply with a court order taken by Mangochi South West lawmaker Shadreck Namalomba against seating arrangements in Parliament.
Namalomba obtained an injunction against Leader of Opposition Kondwani Nankhumwa’s decision to move him from seat number 25 to 100.
Making the announcement Wednesday afternoon, Gotani Hara said Attorney General Thabo Chakaka Nyirenda advised Parliament to comply with the directive as he pursues the matter further in court as per Parliament’s advice.
In an interview, Namalomba has commended the Speaker for abiding by the court order.
“I am happy today because now rule of law is being respected, the courts gave direction and that the direction the speaker you know has moved in that direction.
“They know their Constitution is the Supreme organ of this country and that no one is above the law, even Parliament is not above the law,” Namalomba said.
But Leader of the House Richard Chimwendo Banda said despite the House obeying the Court Order, the lawmakers need be lawfully guided on the National Assembly’s Privilege Act.
He said: “In agreement with the what our own Privileges Act talks about in Section 5 very clearly that we as sitting Parliament may not be served any court order, and we were asking clarity from the speaker.”
“But because that order has been served through the Attorney general, the House has actually agreed to the order, but the Act is still intact.”
