The Lilongwe Senior Resident Magistrate’s Court has given both parties 14 days to make final submissions in a wildlife-related case involving a Zambian national Kerby Malambo.
Magistrate Wanangwa Nyirenda’s determination follows completion of evidence rendered by last defense witness in the trial on Friday.
Making his testimony on Friday, the last defense witness Killian Malunga who was a taxi driver said he took Malambo and drove him to Mwami border.
According to Malunga, the accused did not pay as he said he did not have money which prompted the taxi driver to take hold of his goods.
The witness said Malambo left some his goods and told the taxi driver to come after five hours but when he came back he found that police arrested Malambo and never took his money.
Meanwhile, Magistrate Nyirenda has directed that both parties make their final submissions in the next 14 days.
The 47-year old Zambian national, who was found with a case to answer, was arrested on 28th February 2021 after being found with 22 pieces of Raw African Elephant Ivory weighing 64.905 kilograms without licence from a responsible Minister.
Since his arrest, Malambo has been on remand at Maula Prison in Lilongwe.
Malambo is accused of being found in possession of listed species contrary to Section 86 (1) as read with Section 110B (b) of the National Parks and Wildlife Act, dealing in government trophy contrary to Section 91 (1) as read with Section 110B (b) of the National Parks and Wildlife Act.
And importing specimen of protected species without producing to a customs officer a valid permit contrary to Section 98 (b) as read with Section 111 of the National Parks and Wildlife Act.
