Attorney General Thabo Chakaka Nyirenda has asked the High Court in Lilongwe to consider out of court settlement of a matter in which former Secretary to President and Cabinet (SPC) Zanga-Zanga Chikhosi sought Court injunction restraining police from withdrawing official vehicles from him.
The application follows a stay order that Chikhosi sought late last month pending hearing of an inter partes application for permission to apply for a judicial review.
In an interview, Wapona Kita – lawyer representing Chikhosi said despite the application, the injunction still remains valid and that he will be meeting the defendants soon for a discussion.
“If we agree on terms what means is that we are going to do a retain order, if we fail to agree then the matter will go back to court for the court to decide but we are hopeful that we will be able to reach an agreement.
The injunction continues until the parties agree or fail to agree, we too are in agreement that let’s settle the matter out of court,” Kita said.
Judge Msiska has since adjourned the matter sine die to give room to the discussions.
Chikhosi who was fired by President Lazarus Chakwera in May 2022 and sought the stay order after police stormed his house to collect two official vehicles – Toyota Land Cruiser VXR V8 and a Toyota Land Cruiser Prado.
President Lazarus Chakwera appointed Chikhosi as SPC in 2020 few days after ascending to the presidency following his victory in the June 23 court–sanctioned presidential poll.
Chikhosi was appointed as SPC in 2020, a few days after Chakwera was elected as president in the June 23 elections.
According to the claimant, government is yet to allocate him another job following Chakwera’s remarks that he would be deployed to other duties.
