High Court (Commercial Division) Assistant Registrar Anthony Kapaswiche says he will deliver his ruling on October 3, 2022, on two applications by Gelson Mkweza of Gam Investments and Fuels Limited who wants the court to remove RealSim Company as party to proceedings involving the sale of Gam Fuels Gas Station at Kanengo in Lilongwe.
In the second application, Mkweza wants production of business documents by Masters Borehole Drilling Limited to determine calculation of profits.
In addition, Mkweza through his lawyers has applied for setting aside of execution of order to sale the filling station.
In an interview, lawyer representing the applicant Gimion Nyanda, said the matters can be decided without the court hearing from the Company.
He said: “Because we feel that are under contention in this court can be decided without the hearing from them [RealSim Company].
“We are challenging the execution of processes in this case initiated by the claimant not by RealSim, so we feel that the issue of execution can be decided without RealSim coming to court.”
In other application, RealSim Company wants the order for interim relief which the court granted on August 3, 2022, be removed.
RealSim Company confirmed purchasing the Gam Fuels property at a total cost of K610 million.
Lawyers representing both Masters Boreholes Drilling Limited and RealSim Company have declined to comment on the matter.
