The High Court in Zomba on Tuesday dismissed with costs an application by the Attorney General’s office to dismiss a judicial review of a case in which Rastafarian children are challenging refusal of admission into schools.
The development comes after the office of the Attorney General filed an objection 15 minutes before the hearing commenced for High Court Judge Zione Ntaba to stop hearing an application for judicial review, claiming that there is no such policy restricting the Rastafarian children in schools.
In her ruling, Judge Zione Ntaba has since shown dismay and has faulted the office of the Attorney General for approaching the matter with less attention as it is a human rights issue affecting children.
Speaking to YFM, Lawyer representing the Rastafarian community Ruth Kaima expressed satisfaction with the ruling as the case proceeds to trial.
The matter will return to court on March 14, 2023 for trial.
